In its role as Auctioneer of Lots, Bonhams acts solely for and within the pursuits of the Seller. Bonhams' process is to sell the Lot on the highest worth obtainable at the Sale to a Bidder. Bonhams does now not act for Buyers or Bidders in this role and does now not give advice to Buyers or Bidders. When it or its group of workers make statements about a Lot or, if Bonhams provides a Condition Report on a Lot it's doing that on behalf of the Seller of the Lot. Bidders and Buyers who're themselves now not skilled within the Lots are strongly steered to hunt and obtain impartial advice at the Lots and their worth sooner than bidding for them. The Seller has permitted Bonhams to promote the Lot as its agent on its behalf and, save where we expressly make it clear to the contrary, Bonhams acts most effective as agent for the Seller. Any observation or illustration we make in admire of a Lot is made on the Seller's behalf and, except Bonhams sells a Lot as essential, no longer on our behalf and any Contract for Sale is between the Buyer and the Seller and no longer with us. If Bonhams sells a Lot as fundamental this may increasingly either be said in the Catalogue or an announcement to that impact will be made by the Auctioneer, or it'll be said in a notice at the Sale or an insert within the Catalogue. Bonhams does no longer owe or adopt or conform to any responsibility or responsibility to you in contract or tort (whether or not direct, collateral, specific, implied or in a different way). If you effectively bid for a Lot and purchase it, at that level Bonhams does input into an settlement with you as the Buyer. The terms of that contract are set out in our Buyer's Agreement, which you'll to find at Appendix 2 behind the Catalogue, and this may govern Bonhams' relationship with the Buyer.
Subject to the Contractual Description revealed in daring letters in the Entry in regards to the Lot in the Catalogue (see paragraph Three beneath), Lots are bought to the Buyer on an "as is" basis, with all faults and imperfections. Illustrations and images contained within the Catalogue (other than photographs forming part of the Contractual Description) or in other places of any Lots are for identity functions handiest. A photograph or illustration may not mirror a correct replica of the colour(s) or true condition of the Lot. Lots are available for inspection previous to the Sale and it's for you to satisfy yourself as to each side of a Lot, together with its authorship, attribution, condition, provenance, historical past, background, authenticity, style, period, age, suitability, high quality, roadworthiness (if related), foundation, value and estimated selling value (together with the Hammer Price).
